1. Scope and provider

These Terms & Conditions apply to bookings of quiz-show sessions with Spotlight Studios GmbH, Kurfürstenstr. 16, 80801 München (hereinafter “Spotlight Studios” or “we”). The venue is Barer Straße 46, 80799 München, in the rear building on the ground floor.

2. Offer and conclusion of contract

The display of available sessions constitutes an invitation to submit a binding booking. Booking and payment are handled through the integrated booking process. The contract is concluded once the booking confirmation is sent.

The confirmation includes the date and time, venue and arrival information, number of participants and price, confirmation of payment or access to an invoice or receipt, the cancellation and rescheduling terms, and Spotlight Studios’ contact details. The person making the booking is responsible for passing this information on to all participants and confirms that they are authorised to book on behalf of the stated participants.

3. Service, duration and participation

The standard package “Eure eigene Quiz-Show. Live im Studio.” comprises a two-hour, exclusive group experience with professional hosting and varied game and question rounds. Teams are formed to suit the particular group. One complimentary non-alcoholic drink per person is included.

The stated event duration also includes the organisational elements of the experience, in particular the welcome, introduction, running of the show and conclusion.

The standard format is designed for 6 to 12 participants. For a smaller group, the minimum booking charge for six people applies. Enquiries for larger groups may be made by email; availability is not guaranteed. Only adults may make a booking independently. Minors may participate when accompanied by an adult supervisor.

As a rule, the booked number of participants is binding. If fewer people attend than were booked, there is no entitlement to a partial refund. The number of participants may be increased only with Spotlight Studios’ prior approval and subject to available capacity. Any resulting additional charge must be paid.

The group must arrive in good time so that the show can start punctually.

Spotlight Studios may make minor adjustments to individual game content, question rounds or technical processes for an objective reason, provided that this does not materially impair the overall character or value of the booked service. In the event of a short-notice technical disruption, Spotlight Studios may continue the event using suitable substitutes or an adjusted game format, insofar as this is reasonable.

4. Prices and payment

The prices displayed at the time of booking apply and are stated in euros. All consumer prices include statutory VAT. The price is based on the booked number of participants and must be paid in full in advance at the time of booking.

The available online payment methods are displayed during checkout in the booking process. Cash payment at the venue and payment by invoice are not offered; this also applies to corporate bookings. An invoice or proof of payment can be issued for a paid booking.

5. No right of withdrawal for scheduled bookings

The booked service concerns a leisure activity on a specific date or during a specific period. Pursuant to section 312g (2) no. 9 of the German Civil Code (BGB), there is no statutory right of withdrawal for such contracts. The contractual cancellation and rescheduling options set out below and mandatory statutory rights remain unaffected.

6. Cancellation and rescheduling

Up to seven calendar days before the booked start time, the booking may be rescheduled or cancelled free of charge. If cancelled in time, the full booking price paid will be refunded to the payment method originally used. No booking credit or voucher will be issued instead. Details on how to cancel or reschedule can be found in the booking confirmation.

Less than seven days before the booked start time, cancellation, refunds and rescheduling are excluded. Mandatory statutory rights remain unaffected.

7. Non-attendance and late arrival

In the event of non-attendance, there is no entitlement to a refund or rescheduling. If the group arrives late, the booking will still end at the agreed time. Any resulting reduction in playing time does not give rise to an entitlement to a partial refund. In the event of a significant delay, Spotlight Studios may reasonably shorten or adjust the schedule or individual elements, in particular where necessary to accommodate subsequent bookings.

8. Cancellation by Spotlight Studios

If Spotlight Studios is unable to provide the booked service for reasons for which we are responsible or due to force majeure, the person making the booking may choose between an alternative date and a full refund of the booking price paid. Any further claims for reimbursement of travel, accommodation or other expenses are governed solely by the liability provisions below and applicable law. Further mandatory statutory rights remain unaffected.

9. Conduct, alcohol and exclusion from participation

Spotlight Studios may exclude individual persons from participating or end their participation if they are significantly intoxicated by alcohol or otherwise under the influence, endanger or seriously harass others, repeatedly disregard staff instructions, or significantly disrupt the proper running of the event. In such cases, the excluded person is generally not entitled to a refund. Mandatory statutory rights remain unaffected.

Safety-related and event-related instructions issued by staff must be followed. The premises, furniture and technical equipment must be treated with care.

Participants may take their own photos and videos, provided this does not infringe the rights of others or interfere with the running of the event.

10. Liability

We have unlimited liability for intent and gross negligence and for injury to life, limb or health. In cases of ordinary negligence, we are liable only for breach of a material contractual obligation, limited to the loss typical for the contract and foreseeable at the time it was concluded. Mandatory statutory liability, in particular under the German Product Liability Act, remains unaffected.

Participants are responsible for their own travel to and from the venue. We accept no liability for damage sustained while travelling to or from the studio unless caused by a breach of duty on our part or by our agents. The above principles of liability also apply to damage and injuries sustained in the studio.

In accordance with statutory law, participants are liable for damage they culpably cause to the premises, furniture, technical equipment or other property belonging to Spotlight Studios or third parties.

No special duty of safekeeping applies to personal belongings brought to the venue. Any liability on the part of Spotlight Studios is governed by the above liability provisions and applicable law.

11. Consumer dispute resolution

We are not willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final provisions

The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the country in which they habitually reside. If individual provisions are or become invalid, the validity of the remaining provisions remains unaffected.
